Data Privacy Policy

This Data Privacy Policy ("Policy") describes how Legend Sports Cave, Inc. ("LSC," "we," "us," or "our"), a Texas corporation, collects, uses, shares, and protects personal information about individuals who visit our website, create an Account, purchase a subscription or ticket, or otherwise interact with the CaveCast platform and related services (collectively, the "Platform"). This Policy is incorporated into and forms part of the Ticket Holder Terms of Service. By using the Platform, you agree to the practices described in this Policy.

1. INFORMATION WE COLLECT

1.1 Information You Provide Directly

• Account registration: name, email address, username, password
• Payment information: billing name, address, and payment card details (processed by our third-party payment processor; LSC does not store full card numbers)
• Profile information: display name, profile photo, and any optional biographical details you choose to add
• Communications: messages, comments, questions, feedback, and other content you submit through the Platform or contact us directly
• User Content: comments, messages, images, audio, video, reactions, and other material you submit or make available through the Platform or CaveCast sessions, as described in the Ticket Holder Terms of Service

1.2 Information Collected Automatically

• Device and browser data: IP address, browser type and version, operating system, device identifiers, and hardware model
• Usage data: pages visited, content viewed, CaveCasts watched or attended, features used, clicks, search queries, and time spent on the Platform
• Transaction data: subscription tier, purchase history, billing dates, and renewal status
• Log data: access logs, error logs, and security event data
• Cookies and similar technologies: session cookies, preference cookies, analytics cookies, and local storage — see Section 6 for more detail

1.3 Information From Third Parties

• Payment processors (such as Stripe or Mercury): transaction confirmation, billing address verification, and fraud signals
• Authentication providers: if you choose to log in using a third-party service, we receive basic profile information as permitted by that service
• Analytics providers: aggregated usage and performance data to help us understand how the Platform is used

2. HOW WE USE YOUR INFORMATION

We use the personal information we collect for the following purposes:

2.1 Providing and Operating the Platform

• Creating and managing your Account
• Processing subscription purchases, ticket sales, and payments
• Delivering live and recorded CaveCast content to you
• Enabling interactive features such as comments, chat, and reactions
• Sending transactional emails including purchase confirmations, receipts, and account notifications

2.2 Improving the Platform

• Analyzing usage patterns to understand what content and features our users value most
• Diagnosing technical problems and improving Platform performance and reliability
• Developing new features, Caves, and content offerings
• Conducting research and analytics on aggregated, de-identified data

2.3 Communications and Marketing

• Sending newsletters, platform updates, and promotional communications where you have opted in or where permitted by applicable law
• Responding to your inquiries, support requests, and feedback
• Notifying you of changes to these Terms, this Policy, or the Platform

2.4 Safety, Security, and Legal Compliance

• Detecting, investigating, and preventing fraudulent transactions, abuse, and other prohibited activities
• Enforcing the Ticket Holder Terms of Service and Community Standards
• Complying with applicable laws, regulations, legal process, and lawful governmental requests
• Protecting the rights, property, and safety of LSC, our Legends, our users, and the public
• Preserving and disclosing User Content, Account information, and related records as described in Section 6.6 of the Ticket Holder Terms of Service

3. HOW WE SHARE YOUR INFORMATION

We do not sell your personal information. We share personal information only in the following circumstances:

3.1 Service Providers

We share information with third-party vendors and service providers that perform services on our behalf, including payment processing, cloud hosting, data analytics, email delivery, customer support, and security monitoring. These providers are contractually required to use your information only to provide services to LSC and to maintain appropriate security standards.

3.2 Legends and Cave Directors

When you participate in a CaveCast or interact with a Cave, certain information — including your username, display name, and participation activity — may be visible to the Legend hosting that Cave and to LSC's Cave Directors managing the session. Legends and Cave Directors do not receive your payment information, full email address, or other account credentials.

3.3 Legal Requirements and Safety

We may disclose your information when we believe in good faith that disclosure is reasonably necessary to: (a) comply with applicable law, regulation, legal process, or enforceable governmental request; (b) enforce our Terms of Service or investigate potential violations; (c) detect, prevent, or address fraud, security, or technical issues; or (d) protect the rights, property, or safety of LSC, our users, or the public.

3.4 Business Transfers

If LSC is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you by updating this Policy or providing notice through the Platform if your information becomes subject to a materially different privacy policy as a result.

3.5 With Your Consent

We may share your information with third parties when you have provided consent for us to do so, including for co-branded features, promotions, or integrations you explicitly opt into.

4. DATA RETENTION

We retain your personal information for as long as your Account is active or as necessary to provide the Platform and fulfill the purposes described in this Policy. We also retain information as required to comply with our legal obligations, resolve disputes, and enforce our agreements.

When you close your Account or request deletion, we will delete or anonymize your personal information within a commercially reasonable period, except where we are required or permitted by law to retain it, or where the information is necessary for the exercise or defense of legal claims. Certain aggregated or de-identified data derived from your information may be retained indefinitely.

5. YOUR RIGHTS AND CHOICES

5.1 Account Information

You may access, update, or correct certain personal information by logging into your Account settings. If you need assistance updating information you cannot change yourself, contact us at legal@legendsportscave.com.

5.2 Marketing Communications

You may opt out of receiving promotional emails from us by clicking the unsubscribe link in any promotional email or by contacting us directly. Even after opting out of marketing communications, you will continue to receive transactional messages related to your Account and purchases.

5.3 Cookies

Most browsers allow you to refuse cookies or to alert you when cookies are being sent. Disabling cookies may affect the functionality of certain Platform features. See Section 6 for more detail.

5.4 California Residents — CCPA Rights

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

• Right to Know: the right to request disclosure of the categories and specific pieces of personal information we have collected about you
• Right to Delete: the right to request deletion of personal information we have collected from you, subject to certain exceptions
• Right to Correct: the right to request correction of inaccurate personal information we maintain about you
• Right to Opt Out of Sale or Sharing: we do not sell or share personal information for cross-context behavioral advertising as defined under California law
• Right to Non-Discrimination: we will not discriminate against you for exercising your CCPA rights

5.5 Iowa Residents

If you are an Iowa resident, you have rights under the Iowa Consumer Data Protection Act (effective January 1, 2025), including the right to access, delete, and correct personal data we process about you, and the right to opt out of the processing of personal data for targeted advertising purposes. 5.6 International Users

The Platform is operated in the United States. If you access the Platform from outside the United States, your information may be transferred to and processed in the United States, where data protection laws may differ from those in your country. By using the Platform, you consent to this transfer.

6. COOKIES AND TRACKING TECHNOLOGIES

We and our service providers use cookies, web beacons, pixel tags, and similar tracking technologies to operate the Platform and collect usage information.

Types of Cookies We Use:

• Strictly necessary cookies: required for the Platform to function, including authentication, security, and session management. These cannot be disabled.
• Functional cookies: remember your preferences and settings to improve your experience, such as your preferred Cave or playback settings.
• Analytics cookies: help us understand how users interact with the Platform, which pages and features are most popular, and how to improve performance. We use third-party analytics tools such as Google Analytics.
• Marketing cookies: used to deliver relevant promotional communications where you have opted in. We do not use third-party advertising networks to target ads to you based on your Platform activity.

You can manage cookie preferences through your browser settings. Blocking certain cookies may impair Platform functionality.

7. DATA SECURITY

We implement commercially reasonable technical and organizational security measures designed to protect your personal information against unauthorized access, disclosure, alteration, and destruction. These measures include encryption of data in transit using TLS, access controls limiting who within LSC can access personal information, and regular security assessments.

No method of transmission over the Internet or method of electronic storage is completely secure. While we strive to protect your personal information, we cannot guarantee its absolute security. If we become aware of a security breach that affects your personal information, we will notify you as required by applicable law.

You are responsible for maintaining the confidentiality of your Account credentials. Do not share your password with anyone. Contact us immediately at legal@legendsportscave.com if you suspect unauthorized access to your Account.

8. CHILDREN'S PRIVACY

The Platform is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13 without verifiable parental consent, we will delete that information promptly. If you believe we may have collected information from a child under 13, contact us at legal@legendsportscave.com.

Users between the ages of 13 and 17 may only use the Platform with the consent and supervision of a parent or legal guardian. By using the Platform, users under 18 represent that they have obtained such consent.

9. THIRD-PARTY LINKS AND SERVICES

The Platform may contain links to third-party websites, applications, or services that are not operated by LSC. This Policy does not apply to those third-party services, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party services you access through the Platform.

If you use a third-party payment service to complete a purchase, your information is also subject to that provider's privacy policy. LSC does not control and is not responsible for the data practices of third-party payment processors.

10. CHANGES TO THIS POLICY

We may update this Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will notify you by updating the Effective Date at the top of this Policy and, where appropriate, by providing additional notice through the Platform or by email.

Your continued use of the Platform after any changes to this Policy constitutes your acceptance of the updated Policy. If you do not agree with the updated Policy, you must stop using the Platform and may cancel your subscription in accordance with the Ticket Holder Terms of Service.
